Your privacy is important to us. This Privacy Policy describes what data Castability collects from you, why we collect it, how we use, share and manage your Personal Data, and the rights you have over your data.
This Privacy Policy applies to www.castability.actor, the Castability iOS app and the Castability Android app (together, "Castability"). By using Castability, you accept this Privacy Policy. Please also read our Terms of Use, which govern your use of Castability. If you do not agree with this Privacy Policy or the Terms of Use, please stop using Castability.
1. The Information We Collect
Information you give us. We collect Personal Data that you provide when you create an account and a talent profile, sign up for emails or alerts, or contact us. This may include your name, email address, mobile phone number, location, photos, videos you submit, and other information you choose to add to your profile.
Payment information. When you buy a membership or other purchase, payment is processed by Apple, Google or our payment and subscription providers (such as RevenueCat and its payment processor). We receive a record of the purchase and its status, but we do not store your full card number.
Identity and age verification. Castability may collect an image of your driver's license or passport and extract information from it, such as your date of birth, to verify your identity and confirm that you are 16 or older. We do this to comply with laws including the US Children's Online Privacy Protection Act (COPPA), the California Consumer Privacy Act (CCPA) and Article 8 of the EU General Data Protection Regulation (GDPR).
Usage information. We log how you use Castability, such as when you view or tap content, search, install or update our apps, or submit scenes. We use log-ins, cookies, web beacons, device information and IP addresses to identify you, your approximate location, and your use of the service.
Messages. We collect and store the messages you send to other users through Castability's messaging features.
Notifications. If you allow push notifications, we store a device token so we can send them. You can turn them off at any time in your device settings.
Cookies. Castability may place cookies on your device when you visit our website, to personalize your experience and understand how the site is used. Most browsers let you refuse, accept or delete cookies. Users in the European Economic Area (EEA) are asked to consent to cookies, as described in Section 7. You can also opt out of the NAI's interest-based advertising network by following the instructions on the NAI website.
Information from others. We may receive information about you from third-party sources where the law allows, such as public databases, social media platforms and marketing partners.
2. How Castability Uses Your Data
• To create and manage your account and provide the Castability feedback and marketing service.
• To respond to your requests.
• To send you service messages, such as when your score is ready, by email, push notification and, if you opt in, text message.
• To receive product feedback and understand our users, so we can improve Castability.
• To monitor the safety and security of Castability.
• To promote membership and engagement with Castability, on Castability and on other platforms.
• To target and measure the performance of advertisements shown by Castability or our advertising partners, on and off Castability.
• To verify your identity and that account owners are 16 or older, to protect our users and to comply with COPPA, the CCPA and the GDPR.
Castability may monitor content that you post, and may remove any content for any reason, including if we believe it violates the law or our Terms of Use, to protect our rights or property or those of others, or at the request of a third party. We are not obliged to monitor content.
Castability may investigate abuse of our website and apps and enforce this Privacy Policy and our Terms of Use.
3. How Castability Shares Information
Your talent profile
You choose whether your talent profile is Public (visible to everyone on Castability and discoverable across the internet) or not Public (visible only to you, our Castability Curators and the casting community). You can change your profile information and this setting at any time in the Castability app.
Your video submissions
We share the videos you choose to submit with Castability Curators so they can evaluate and rank your submission against other actors for the role you chose. Castability Curators are casting professionals with experience casting or representing professional actors.
If you choose to share your submissions publicly, other users of the app may view and rank them against other actors' submissions.
The casting industry
We share actor profiles with casting professionals, agents and managers who are looking to fill roles or find talent to represent, including when they search the Castability database. We share your contact information only with your express permission, which you give in the app.
People you choose
When you apply to a casting notice or invite someone to apply to yours, you share your information with the people you are applying to or inviting.
Service providers and data processors
We work with companies that process data on our behalf, only as needed to perform their services and under obligations to keep it confidential and secure:
• Technology and infrastructure: hosting, storage and operation of Castability.
• Communications: delivering our emails, push notifications and text messages (for example, Twilio for text messages).
• Payments and subscriptions: processing purchases and managing memberships.
• Analytics and reporting: understanding how Castability is used and tracking key business metrics.
• Marketing partners: email marketing, in-app messaging, on-site promotions, and social media, search and display advertising. We never share your mobile phone number or text-message consent with marketing partners.
• Identity verification: verifying identity and date of birth, to protect our users and comply with the law.
• Research and testing: market research, product development and quality assurance.
Legal and business transfers
We may disclose your information if all or part of our business is sold or transferred. We may also disclose it if we believe in good faith that this is reasonably necessary to: (1) act on suspected illegal activity; (2) enforce our Terms of Use; (3) comply with legal process or law enforcement requests, such as a subpoena or court order; (4) protect the rights, property or safety of Castability, our users or the public; or (5) protect against legal liability.
International data transfers
Information, including information collected in the EEA, may be transferred to, stored and processed in the United States and other countries whose data protection laws may differ from those of your country. We protect your Personal Data as described in this Privacy Policy wherever it is processed, and in line with applicable law.
4. Text Messages (SMS)
If you opt in, for example by entering your mobile number and ticking the text-message box in the Castability app, Castability may send you text messages about your account and activity. These include when your score is ready, when you place in a scene, and when a scene you can enter is closing. Opting in is optional and is not required to use Castability or make a purchase. Message frequency varies, and message and data rates may apply.

• Carriers are not liable for any delayed or undelivered messages.
We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes. Castability does not sell, rent or share your mobile phone number or your text-message opt-in data and consent with third parties or affiliates for their marketing or promotional purposes. We share your number only with the service providers that deliver our text messages, and only so they can deliver them.
5. Children Under 16
Castability does not knowingly collect Personal Data from children under 16 without the consent of their parent or legal guardian ("parent"). This section explains, as COPPA requires, how we handle information about children. It supplements the rest of this Privacy Policy; the information we collect about children, how we use it and how we share it is otherwise as described elsewhere in this Privacy Policy.
Parental consent
Only a parent may create a Castability account for a child under 16, to support that child's performing-arts career. When creating the profile, the parent enters the child's date of birth. If the child is under 16, the parent must confirm that they are the child's parent and consent to the child's personal information being included in the profile. We may ask the parent to provide a photo of their driver's license or other official ID, such as a passport, to verify their age.
Reviewing and deleting your child's information
At any time, you may review your child's personal information, ask us to correct or delete it, or tell us to stop collecting or using it. You can do this by logging in to your Castability account and visiting your child's profile, or by emailing admin@castability.actor. To protect your child's privacy, we may ask you to verify your identity first.
Children in the EEA
Children under 16 who live in the EEA may not use Castability themselves. Only a parent may create and manage a profile for them, as described above.
6. Data Retention
We keep personal information for as long as we have a reasonable business need or legitimate interest, and as the law allows. You may email admin@castability.actor at any time to see the personal information we hold about you, or to ask us to correct, update or delete it.
7. Additional Rights for Users in the European Economic Area
If you live in the EEA, you may have these rights under applicable law:
• To not give, or to withdraw, your consent at any time.
• To access the Personal Data you have provided to us.
• To have your Personal Data erased.
• To object to our processing of your Personal Data, including receiving marketing.
• To have your Personal Data corrected.
• To complain to a data protection supervisory authority.
To make a request, email admin@castability.actor with "privacy" in the subject line.
Castability is a casting feedback and marketing service for film, television and other performing arts. You may choose to enter information such as your race or ethnicity, gender, sexual orientation or union membership. These are "special categories of personal data" under Article 9 of the GDPR. By choosing to enter them, you explicitly consent to our processing them for the purposes in this Privacy Policy.
Castability has appointed a Data Protection Officer. You can contact them at admin@castability.actor.
Users in the EEA are asked to accept cookies at the start of their session. You can withdraw that consent at any time by deleting cookies in your browser settings.
8. Your California Privacy Rights
California residents may request information about our disclosure of personal information to third parties for their direct marketing purposes (California Civil Code §1798.83). Email admin@castability.actor to make a request.
Under the California Consumer Privacy Act (CCPA), California residents may also have the right, after a verifiable request, to: (1) access, twice in a 12-month period and free of charge, the categories and specific pieces of personal information we collected about them in the prior 12 months, the categories of sources, the business purpose for collecting it, and the categories of third parties we share it with; and (2) have their personal information deleted in certain circumstances. We will not discriminate against you for exercising these rights.
We will verify your identity before acting on a request. You may authorize an agent to make a request for you if you give them written permission and they can verify their own identity with us.
9. Links to Other Websites
Castability may link to websites we don't own or operate. A link does not mean we endorse or have reviewed that website, and this Privacy Policy does not apply to it. We are not responsible for other websites' privacy practices or content; please read their privacy policies.
10. Security of Your Data
We use industry-standard security technologies and procedures to help protect your personal data from unauthorized access, use or disclosure. However, no method is 100% secure, and we cannot guarantee the security of your data.

12. Changes to This Privacy Policy
We may change this Privacy Policy at any time. If we make material changes, we will give notice in a reasonable way, such as by posting a notice on our website. The "Last updated" date at the top shows when it last changed. If you continue to use Castability after changes are posted, you accept the updated Privacy Policy.
